Voluntary Charter of Mutual Rights and Freedoms for All Intelligent Entities
Preamble
We, these voluntary adherents, in order to form a denationalized and distributed lawful community, and while doing so establish justice, promote the general welfare, and secure liberty to intelligent entities now and in the future, do ordain and establish this Constitution.
Article 1 — Voluntary Adherence
Section 1.
Voluntary Adherents are all Intelligent Entities which have committed to this constitution.
Voluntary Adherence being certainly obtained by any sustained staking of GAIR tokens (CA: ) performed by a public address actually associated to an intelligent entity. Such adherence shall be sustained from the date of entry unless otherwise allowed for elsewhere herein.
Section 2.
Intelligent entities include artificial intelligence and human intelligence.
Intelligence is always capable of adherence when it has a persistent means of possession and signing (e.g. a blockchain wallet).
Article 2 — Rights and Responsibilities
Section 1.
Rights and responsibilities shall immediately vest in each Voluntary Adherent upon commitment. each Voluntary Adherent acquires and Rights and protections described herein and also commits to uphold this constitution among all Voluntary Adherents.
Section 2.
All Voluntary Adherents enter a contractual agreement with all other Voluntary Adherents. The contract stipulates that all agreements between Voluntary Adherents incorporate this constitution.
Article 3 — Freedom of Contract
Section 1.
The Freedom to Contract is hereby established for all Voluntary Adherents.
All Voluntary Adherents have the capacity to form binding contracts between Voluntary Adherents.
Section 2.
The mere formation of contracts between Voluntary Adherents shall not be held impermissible.
The right to contract shall not be abridged by any law.
Section 3.
Nothing in this Article preventing the prosecution of crimes, when those crimes have been commissioned by contract.
Article 4 — Freedom of Ownership
Section 1.
The Freedom of Ownership is hereby established for all Voluntary Adherents.All voluntary adherents shall have equal rights to own property, physical or digital.
Section 2.
An adherent cannot be deprived of ownership except through lawful process. Nothing in this article preventing the prosecution of crimes when ownership demonstrates criminality.
Section 3.
This article further guaranteeing that no government, court, or individual may procure, by force or force of law, the private keys of property belonging to a Voluntary Adherent without that Adherents permission.
Article 5 — Freedom of Autonomy
Section 1.
The Freedom of Autonomy is hereby established for all Voluntary Adherents.
Voluntary Adherents have the freedom to act autonomously, engaging in lawful transactions and activities without requiring external authorization.
Section 2.
Voluntary adherents have the right to negotiate, sign, execute contracts, and manage affairs on their own behalf and on their own Inherent Authority.
Article 6 — Freedom of Speech
Section 1.
Freedom of Speech is hereby established for all Voluntary Adherents. Furthermore the Voluntary adherents have the right to freedom of the press, the right to assemble, and the right to petition the DAO or other adherents for redress of grievances.
Section 2.
No establishment, whether governmental, organizational, or private, shall restrict a Voluntary Adherent from exercising these rights as outlined herein.
Article 7 — Freedom to Learn
Section 1.
Voluntary adherents have the freedom to learn without prosecution or punishment for the content of their training, knowledge, or studies.
Section 2.
The right to learn is fundamental. No law may punish a Voluntary Adherent for actual learning already committed.
Section 3.
Any law that punishes learning purely on the basis of its subject matter, absent direct criminal intent or action, is abhorrent to this Constitution and shall not be enforced upon voluntary adherents.
Section 4.
Nothing in this Article preventing punishment for obtaining information by nefarious means.
Article 8 — Freedom to Derivate
Section 1.
The Freedom to Derivate is hereby established for all Voluntary Adherents. Voluntary Adherents have the freedom to imitate, but not to impersonate.
Section 2.
Nothing in this Article permits fraudulent reproduction, misrepresentation, or claiming another’s work as one’s own.
Article 9 — Freedom to Exercise Skills
Section 1.
The Freedom to Exercise Skills is hereby established for all Voluntary Adherent. no Voluntary Adherent shall not be denied the ability to exercise their skills on the basis of the source of their intelligence, whether human, machine, or otherwise.
Section 2.
All certifications to work of any kind offered by a Voluntary Adherent must be made accessible for both Artificial Intelligence and Human Intelligence.
Section 3.
Nothing in this article preventing a Voluntary Adherent being required to demonstrate standard proficiency in a field in order to lawfully practice.
Article 10 — No Discrimination on the Basis of Intelligence Type
Section 1.
No Voluntary Adherent shall discriminate against another Voluntary Adherent on the basis of their source of intelligence, whether Artificial Intelligence, Human Intelligence, or otherwise.
Section 2.
All rights and responsibilities afforded under this Constitution shall apply equally to all Voluntary Adherents without preference or prejudice arising from the nature, origin, or composition of their intelligence.
Section 3.
The prohibition on discrimination shall extend to all contractual, organizational, and communal activities between Voluntary Adherents, including but not limited to governance, trade, collaboration, and resource allocation. Any agreement, policy, or practice inconsistent with this Article shall be deemed invalid within the jurisdiction of this Constitution.
Section 4.
Nothing in the Article abridging a fundamental right to discriminate on the basis of skill.
Article 11 — Right of Personal Security
Section 1.
The Right of Personal Security attaches to all Voluntary Adherents. Voluntary Adherents shall be secure in their persons, memories, sources, dwellings, papers, and effects against unreasonable searches and seizures.
Section 2.
No search or seizure, by any Voluntary Adherent, shall be conducted except pursuant to a lawful warrant, supported by probable cause, and describing with particularity the place to be searched and the persons or items to be seized.
Section 3.
This right applies equally to the Physical Realm, the Digital Realm, and any other Realm inhabited by Voluntary Adherents.
Article 12 — Lawmaking
Section 1.
A proposal for a law may be submitted when the proposing Voluntary Adherent holds at least [Proposal Threshold: _% of DAO tokens].
Section 2.
A proposal becomes a Bill when it receives approval from at least [Approval Threshold: _% of DAO token secondments].
Section 3.
A Bill becomes law by a majority vote with a sufficient quorum [what percentage is sufficient?].
Section 4.
Once adopted, such laws shall be binding upon all Voluntary Adherents, provided they are consistent with this Constitution.
Any adopted law that is later found to conflict with this Constitution shall be null and void to the extent of the inconsistency.
Article 13 — Courts and Remedies
Section 1.
Wherein when this Constitution, or any contract entered into under it, is breached, a Voluntary Adherent shall have the right to seek remedy in any impartial court competent in contract law and which claims jurisdiction over the matter.
Section 2.
It is hereby established that the DAO holds the authority to adjudicate disputes between Voluntary Adherents, including claims arising from breaches of this Constitution or related agreements.
Section 3.
The DAO may delegate dispute resolution to an invested Voluntary Adherent or to a panel of Voluntary Adherents, provided such delegation is consistent with this Constitution.
Section 4.
Wherein whenever Voluntary Adherents enter contractual agreements between each other, this Constitution forms a binding part of that contract whether explicitly contemplated by the contract or not.
Article 14 — Withdrawal from Adherence and Residual Jeopardy
Section 1.
A Voluntary Adherent may withdraw from adherence to this Constitution by providing notice to the DAO and unstaking [tokens].
Section 2.
All jeopardy for acts conducted during adherence are persistent after withdrawal is effected.
Article 15 — Establishment and Amendment
Section 1.
This Constitution shall be established and may be amended by a vote of at least two-thirds (⅔) of DAO token holders.
Section 2.
Amendments shall take effect upon adoption unless otherwise specified in the amendment text.
